This makes absolutely no sense. The rules is simple ; dont mod your 360. If you want to mod your 360, you're going to void your warranty and you cant play online. Everyone online needs to have the same, standard 360. It's unfair to have some players playing with enhanced consoles. So dont do it. So some people ignored that rule. They modded their consoles anyway, and then even modded them further so they can play online (the 360 automatically does not let you play online if your 360 is modded. Getting it to play online requires further modification). So they knew the rules, they broke the rules, they took their 360 online knowing the rule is 'do that and we'll ban you', and they got banned. Why the arguing then? Why the blaming microsoft?

Where do you see me blaming M$ for other than the fact that they are M$? :) They set the rules clearly and people violated it so yeah they knew the consequences. I'm pointing the hypocrisy of saying that it is ok for noble and righteous human beings to copy songs that are copyrighted material from record companies but somehow only the scum of the Earth misuse the copyrighted material of M$.

I'm pointing the hypocrisy of saying that it is ok for noble and righteous human beings to copy songs that are copyrighted material from record companies but somehow only the scum of the Earth misuse the copyrighted material of M$.RedruM_I

You never answered my question, have you ever copied a mp3 from a friend? a cd? downloaded a song? I find hard to believe that in this day and age somebody with a computer haven't done any copyright infringement at any time.

I guess it's only fair then when a 120 gb hard drive cost $100 and you can't use another brands hard drive with-out the chance of getting banned now? Why do you lemmings side with getting ripped off? Seriously. I can get a terrabyte hard-drive from any manufactuer and place it in my ps3 without voiding the warranty , hell instructions on how to do this are in the ps3 manual - and at the same $100 cost of the 120gb , thats ps3 -1000gb vs 120gb for the same money... of course people are going to want to do that! Not everyone with a custom hd on 360 is a pirtate, they do sell movie rentals, demos and you can put you videos demos, mp3s and photos on there can't you? that takes up space you know. I have a 320gb hd in my ps3, guess what I only have 60gb left from all the stuff i download from the psn store or that I transfer over.Midnightshade29

this argument is absurd for several reasons.

1) if you want increased storage space for movies and music, you can attach anexternal hard drive, or your computer, to your xbox 360. if an old man like myself can do this there is literally no reason why a generation of people raised around computers cant figure it out.

2) the price argument is a non argument. whether it is fair or not is irrelevant, because there is no benchmark for 'fair' when an item is a total luxury. the only people who think 'fair' enters this equation are people with an entitlement mentality. hdds are not like food, water, or shelter. theyre for spoiled people who like to burn through money on worthless toys like you and me.

i agree the prices are GOUGING. theres no doubt about that. but thems the breaks when it comes to stuff like this.

Yes, cause wanting a reasonably priced HDD is hacking.

Technically it is. You violate the EULA by modifying your console. Which means MS is totally within their rights to ban you.

But the hard drive is external to the console itself. I can take it off, and it's designed to be taken off and can be run without it--ergo, it's not an integral part of the console.

It can. If my friend across the street works the exact same job and is paid considerably more, I might start taking it up with the higher-ups, especially if I get the competition to make advances on me. No boss worth his salt will want a defection.

It voids the warranty but they don't destroy your car.

Banned 360's can still play 360 games. You should not have access to any feature that requires XBL silver or gold. Also you shouldn't be allowed to store games to the HDD for obvious reasons.

But a modified car can still be fully driven. One reason for the hard drive is for game caching (not pirated game storage, I refer to the game cache ability that still need the game disc in it), which not only saves time but also wear, tear, and heat on the console itself. Not to mention the hard drive is technically external to the console.

Now that could have a case. Even if it's aftermarket, if the part carries a Microsoft seal, that means Microsoft vouched for it. If Microsoft bans for a part they themselves vouched for, they're reneging, and you (or probably Mad Catz) can take Microsoft to court for breach of contract on those grounds.

Using a REGULAR HDD is a risk of creating hacks to games, thus those that simply use it as a cheap alternative to the overpirced Hard drives are getting the same treatment as those that use it to hack games. Microsoft can't go door to door asking people "hey, we see you are using a third party HDD... do you hack??" It has little to do with people not spending microsofts outrageous prices, but far more to do with the high level of risk that a third party harddrive allows. The problem with lawsuits like this, even if there are people who are simply using a harddrive just to get more room and save money, IT IS AGAINST THE XBOX 360 TOS that everyone has to sign to sign up to xbox live. You are breaking the TOS the second you mod your system for whatever reason, be it to pirate software, hack games or simply give extra space without paying a ton of money. Whatever the reason IT IS AGAINST THE 360 TOS. Microsoft is greedy sure, but they aren't stupid. The people setting up this ****action lawsuit are stupid for thinking that they have a chance to even win a case that is clearly in favor of Microsoft.

It can. If my friend across the street works the exact same job and is paid considerably more, I might start taking it up with the higher-ups, especially if I get the competition to make advances on me. No boss worth his salt will want a defection.

Do you have a job or even worked in the corporate world? They don't give a flying rats ass what your friend makes, they'll get someone who will work for they salary they are paying. Where is this place fantasyland?

And what if you're a specialist and replacements are few and hotly contested?

MODs, please lock this, its nothing but cows trying to spin banning hackers/modders into flamebait. Bottom line is that modding your console for piracy, or to use other hard drives is against the TOU. Whether you agree with the rule or not is a different story. Most of us the the tech community know that allowing 3rd party hard drives opens the door to piracy. Im in no way saying ALL people using other hard drives is pirating, or hacking the console, but simply ALLOWING it opens the door for game save modification (spamming achievements), DLC/DL game modification, etc. Microsoft is just protecting their investment, and maintaining the integrity of the community. I agree, the prices of the hard drives is outrageous, but that is irrelevant here.

Doesn't matter. When you start a job, you probably sign an offer letter that explicitly lists that offered salary and that you agree to that as your starting wage. Employment is a totally voluntary agreement. Both parties can opt to end the agreement at any point.

In other words, you're free to quit, if you think you can get a better paycheck elsewhere.

Or you can go right ahead and talk to your boss and bring up the competition, and ask for a raise. Nothing wrong with that. And they can say no. Nothing wrong with that either.

But (looping this back to the original topic), you don't have a legal leg to stand on if you think you can sue your current employer because a competitor offers better pay.

Ah, I love it when I'm right. I called this whole ordeal the first time I heard of the banning. It's like right after MW2 MS all of a sudden notices "Oh wowwy! We have hackers!?" like they didn't know prior to it. Not only will they make a killing off of renewed XBL subscriptions, but also by the fact that people will have to buy another Xbox. Just in time for the Holiday Season too.

I have no problem with them banning people with modded Xbox's, but I'm sure MS really just did it for money, not because they really care that much about modders. They could've doe this a really long time ago, yet they choose to do it at a time where huge games are being released. Almost everything MS does is for money.

Awesome. Love that they let the pirates get a bit complacent before screwing them over. And it's definitely not outside of their rights, as the EULA specificially states that any console modifications are grounds for banning. Why people think there's a lawsuit in there I have no idea. Well, other than people in the US hellbent on suing anyone any time anything happens.

If you chip your xbox and then continue to play online you are pretty dumb, its obvious they are going to detect you and ban you. People saying 'I just chipped is so I could use another hard-drive, I'd never play a copied game' are being disingenuous to say the least.

How are they going to profit off of pirated games? Xbox Live subscriptions? That is quite a stretch. Anyway, wasn't MW2 intentionally leaked with code that would expose the hacked consoles?
