Didn't they learn ANYTHING from the Wii U branding stupidity? Not only will there be people confused about The XBX being just another version of the XB1, but it's smaller than the X Box S... but that "S" is supposed to represent "small".

Also, now it sounds like one of those XXXAnimenameXXX mmo names you see everywhere.

@bwats84: There's a big difference between seeing professionally done explosions in motion and a poster though. The fire and explosions aren't even done well here.

How the heck did that poster get approved? It's as if an amateur did it, just plastering in all the stars and adding what he thought would look cool because FIRE and EXPLOSIONS.

@Thanatos2k: Unfortunately it's not a lie... at least, not the way they worded it. I studied it in trademark law class. A very prominent example of what happens when it's not enforced is with "Refrigerator", which was the name of the company who originally made fridges and trademarked the name. When others started using the name refrigerator as a casual term for it, the original company didn't fight it, and by the time they DID bring someone to court over it, they lost the rights to the name.

It's a damned if you do, damned if you don't situation in that regard, but I don't see why they couldn't have done something like objected to the use, then not follow through on the case and let the case expire. I believe that is an option, though admittedly I'm rusty in that area since it's been a while.

However, Zenimax IS being way too aggressive with its trademarks as they're actually trying to stop people from using it, not simply making an objection, so the way they worded their excuse is not really what they're doing. They could make a simple objection to it and leave it at that, but they're instead suing companies for infringement.

@registeredpunk: Except there are people who don't see it as art and take it so seriously they start wars over it. This applies to nearly all religions.

I agree with your concept but tragically there are always those minorities in every religion who spoils it for everyone else

@tinyjotun: Because they DIDN'T know? It's not as if they want to waste time and money doing this. The fact that such a blatant mistake got through is massively sloppy though
