Like the guy or not, (Not the kind of guy I would get along with, personally) but those are the facts.

A CEO move for a company of this size takes months to arrange and negotiate; this has been in the works for quite some time. @Tridus Cert has a lot of departments. The guys from Functionality or Gameplay (if available) should have spotted this. Not to foerget the guys in First Party Approval missed it too (Was a bit shady, yes, but still).
Ui conventions and third party guidelines are covered by Cert, yes, but it is the Compliance Department and (in some cases) Submissions department the ones taking care of that (along with the age rating pass).
We are talking about a small indie studio. So it's expected that their QA is specialized to cover the full stuff or outsource it if necessary.
@Tridus @Warlord_Irochi Problem is that each time you patch a game (I also disagree with how much Ms charges for patches. but first patch on 360 is free) you make QA re-test the game to ensure everything was correctly implemented. It's a standard procedure that either they skipped or ignored the reports (common most of the time) and at the end a lot of players had to suffer the consequences.
