It wasn't all that common until Apple released it and made a killing on it. In fact it didn't exist at all on tablets. The other thing to keep in mind is that there is always more than meets the eye with these sorts of legal battles. It is easy to just dismiss it as Apple being a tyrant, but when you cut through the old crap cake, it is one company defending what they believe to be their own intellectual property, perfected through their own research and development (Apple's R&D budget is, substantial). It goes without saying that Apple's unbelievable success is the reason people are reacting so strongly to this news. It's like everyone admitting that Apple is so good it's unfair to everyone else, so they should cut Samsung and Motorola a break. Maybe we should put more pressure on those companies to introduce a new kind of product that changes the technological culture around us. What about that?musicalmac

You can't just patent a tablet (or at least you shouldn't be able to) because it fails the basic test of inventive step/non-obviousness -- as years upon years of sci-fi films have demonstrated (nevermind the various tablets and tablet-like devices that pre-date the iPad), no duh, a handheld computer with a touchscreen is a pretty great-but-obvious idea. A patent is supposed to cover the specifics of an invention, not "yep, it's a tablet" like the design patent that's apparently the basis for Apple's case(s).Â
Granted, maybe there is more to this than "Apple uses overly broad patent and comically biased legal juristiction to stifle legitimate competition", but I sure haven't heard anything to the contrary (and I usually end up semi-defending Apple).Â
Speaking of Linux -- MS Filing Drops Linux as a Threat I also came across these items, which seem relevant to our conversation. The Dell Streak tablet is dead, and no longer available for sale. Along the same lines, Sprint has decided not to sell RIM's 4g Playbook tablet (a name that makes no sense for a company like RIM). Just more blood on Apple's hands. So much death. :(If all OSes were made equal in terms of games, I would be using Linux all day erryday.

I don't have all the answers, I thought I'd just bring it here and see how it played out. It does seem extra broad to me, too. But like I said earlier, objectively when you cut down through the crap cake, it is one company defending something they believe to be their IP.
Yeah, I think our discussion was very different from the rest of the thread.
So with that in mind: I picked myself up a Nexus S a few weeks ago and it's actually pretty spectacular. Once more devs jump on the platform and the Marketplace rounds out, I'd give it the nod over iOS (currently, obvioously. Who knows how iOS 5 v. ICS will turn out).Â

As John at Edible Apple and others have pointed out, Apple's evidentiary submission is not limited to the inaccurate comparison photo, as Apple did also offer a number of other exhibits in support of its case, including some showing actual side-by-side photos of the iPad 2 and Galaxy Tab 10.1 rather than just promotional images. Consequently, it stands to reason that the judge's decision was not based entirely on the flawed comparison, although the inclusion of inaccurate information in Apple's submission certainly is a curious one.MacRumors

And has anyone used a Blackberry Playbook yet? It's so darn small, kind of the in-between sized tablet. The useless size.musicalmac
No because lolblackberry, but the form factor is supposed to actually be pretty useful. It's big enough you can comfortably use it for tablet-y stuff like browsing and watching videos, but small enough that you're more likely to carry it around when on-the-go than a relatively large iPad.

I don't even think the iPad is that "big" or hard to carry around. I have a little cover for it, and it's light enough, that I can just carry the thing in my arm... If I need to "stuff" it somewhere, a messenger bag, or something works just fine. As for "using" it, well the size for me is just fine I feel. I hold it with one arm supporting it from the back, my hand clasping the top, and then my other hand does the work.
