Terminology is important.
No one is 'stealing' Xenoblade by downloading it illegally. They're making copies of it. It's still genuine considering it hasn't been altered or modded in any way -- and the original copy is still in tact.
It's not really a dumb comment ... it's just terminology. It becomes a different issue when you're dealing with digitized content versus physical. I can steal a copy of Xenoblade from a GameStop and it's not in their possession anymore. I can't say the same if I download a copy of Xenoblade, it's still available to anyone else.
When you make a copy of something, it's still theft. You're taking something that you have no right to own. It wasn't sold to you and it wasn't given to you by those who own it. Therefore you're taking/copying it against their will, which is stealing.
