When did they open the beta up? I was asked to sign an NDA last week when I finally got around to re-activating my Funcom account to participate. According to Bloomberg, their fiscal year runs concurrent witht he calendar year, so I still think D3 (and maybe even TERA) was probably a factor.
Do you know what a beta is? It isn't a demo, intended to drum up interest in the project. It is for testing the game, Beta testers are supposed to give feedback to the devs, not GameSpot readers.
Putting a little extra space between themselves and "Diablo" 3 seems wise to me. As for all the negative comments from "beta testers", I am pretty sure the game is still under a strict NDA so by definition these people aren't honest and thus their opinions can't be trusted.
This seems to back up West and Zampella's version of events. If the rest of the evidence looks even a little like this, Activision is in trouble. I suppose we will know soon.
Motorola is abusing its patent portfolio in this case and many others. They own patents that EVERYTHING uses and are required to allow others to use them for a reasonable fee. They are negotiating in bad faith in this case and others (notably cases involving Apple) to enhance their market position. This is the reason Google wanted them (the flagship Android phone is made by Samsung).
